Welcome to BoonTools! These Terms of Service ("Terms") govern your use of the BoonTools mobile application (the "App") operated by Sun Orbit Labs ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

1.1 Age Requirement

The App is rated 9+ and suitable for users 9 years of age and older. For users under 13, we recommend parental guidance and supervision when using the App. If you are under 18, you must have parental or guardian consent to use the App.

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the App after changes constitutes acceptance of the modified Terms.

2. Account Terms

2.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

2.2 Account Security

You are responsible for maintaining the confidentiality of your account information. We are not liable for any loss or damage from your failure to comply with this security obligation.

3. Subscription Terms

3.1 Subscription Tiers

The App requires an active subscription to use. There is no free tier or free-to-use mode; a Plus or Pro subscription is required after onboarding. BoonTools offers two subscription tiers:

• Plus ($6.99/month CAD): Full access to all 9 tools with cloud sync
• Pro ($12.99/month CAD): All Plus features plus AI-powered tools

3.2 Payment and Billing

• Subscriptions are processed through the Apple App Store
• Payment is charged to your store account upon confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

3.3 Cancellation and Refunds

• You can cancel your subscription anytime through your Apple ID subscription settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Refund requests must be made through Apple or Google's respective refund policies

4. Acceptable Use

4.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon others' intellectual property rights
• Upload malicious code or harmful content
• Attempt to gain unauthorized access to our systems
• Use the App to spam, harass, or harm others
• Reverse engineer or attempt to extract source code
• Use automated tools to access the App

5. Content and Data

5.1 Your Content

You retain ownership of all content you create and store in the App. You grant us a limited license to store, process, and sync your content across your devices.

5.2 Content Responsibility

You are solely responsible for your content and must ensure it complies with applicable laws and these Terms.

5.3 Data Backup

While we provide cloud backup services, you should maintain your own backups of important data. We are not liable for data loss.

6. Privacy

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://boontools.ca/mobile/legal/privacy.

7. AI Features and Data Usage

7.1 AI Processing (Pro Tier)

AI-powered features use third-party services (including OpenAI and Gemini AI, and may include additional providers in the future) to process your data and provide:

• Smart suggestions
• Content summaries
• Intelligent search
• Predictive features

7.2 AI Data Usage

When using AI features:

• Your content may be sent to third-party AI providers (OpenAI, Gemini AI, and potentially others)
• Data is processed according to their privacy policies
• We do not use your data to train AI models for other users
• You can opt out of AI features at any time

7.3 AI Accuracy

AI-generated content is provided "as is" without warranties of accuracy. You should review and verify all AI-generated suggestions before relying on them.

8. Disclaimers

8.1 "As Is" Service

8.2 Service Availability

We do not guarantee that the App will be available 100% of the time. We may experience downtime for maintenance, updates, or technical issues.

9. Limitation of Liability

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of applicable laws
• Your content or conduct

11. Termination

11.1 Termination by You

You may terminate your account at any time by deleting the App and canceling your subscription.

11.2 Termination by Us

We may suspend or terminate your account if you violate these Terms or for other reasons at our discretion. We will provide notice when possible.

11.3 Effect of Termination

Upon termination:

• Your right to use the App ends immediately
• Your data may be deleted after 30 days
• Surviving provisions of these Terms remain in effect

12. Legal Terms

12.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at toolsboon@gmail.com to attempt informal resolution.

12.3 Court Resolution

Any disputes arising from these Terms or the App that cannot be resolved informally shall be resolved through the court system. You retain all rights to jury trial and class action participation as provided by applicable law.

12.4 Jurisdiction

You agree to submit to the exclusive jurisdiction of courts in the applicable jurisdiction for any disputes.

13. General Terms

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sun Orbit Labs regarding the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms.

13.5 Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
